John McCusker and Patti Prezioso , with the assistance of Katie Lopez, Suzanne Murphy and Laura Stuart , recently won a no cause verdict for the defendants, a global Fortune 500 pharmaceutical company and former employer of the plaintiff, in a CEPA or whistle blowing action. While the plaintiff contended that he was terminated for alleged whistle blowing activity, the jury concluded he had not engaged in whistle blowing activity and returned a verdict in favor of MARC 's client.
John McCusker, Rose DaSilva, Laura Stuart and Suzanne Murphy recently won summary judgment on behalf of a Fortune 50 Oil Company in an ERISA action where plaintiff sought the recovery of long-term disability benefits under a company welfare benefit plan. They successfully argued that the plan's denial of plaintiff's claim for long-term disability benefits was not arbitrary and capricious.
John McCusker, Suzanne Murphy and Jared Resnick recently secured affirmance by the New Jersey Appellate Division on behalf of a Fortune 50 oil company and 11 individually named defendants, dismissing a former employee's CEPA and LAD claims. The appeal was based upon the trial court's granting of the clients' Motion for Reconsideration, dismissing plaintiff's claims for failure to provide discovery.
Rose DaSilva, Suzanne Murphy and Laura Stuart recently won summary judgment on behalf of a major corporation in an ERISA action where plaintiff sought the recovery of long-term disability benefits under a company disability benefit plan. They successfully argued that the plan's denial of plaintiff's claim for long-term disability benefits was not arbitrary and capricious.
Bruce S. Rosen and Patti Prezioso successfully challenged and overturned Ms. Prezioso's disqualification as counsel for a New Jersey State Trooper under criminal investigation. A Superior Court judge had ruled Ms. Prezioso's appearance was a conflict of interest because she had been a highly visible assistant Attorney General before she joined MARC , and the decision would have meant that all deputy and assistant attorney generals would be barred from representing criminal defendants for six months even if they had nothing to do with initiating or prosecuting the case at issue. Deciding an emergent appeal, the Appellate Division overruled that decision, declaring that no conflict existed. MARC is proud to announce that Patricia Prezioso has joined the firm as Partner. Immediately prior to joining the firm, she served as Executive Assistant Attorney General for the State of New Jersey, where she oversaw complex litigation and trials within the Division of Criminal Justice and developed and ran the state's convicted offender DNA program. She will be part of MARC 's white collar defense team
MARC mourns the loss of our friend and longtime associate Amy C. Grossman , who passed away on July 22, 2007 after a long and courageous battle with lupus. Amy will be greatly missed.
